1. INTRODUCTION

This data protection policy (“Data Protection Policy”) forms a part of the Terms of Service of the website hosted under the domain names of www.theranking.com and www.rocktherank.com (collectively, “TheRanking.com”). Any term used which is not expressly defined in the Data Protection Policy, will have the meaning attributed to it in the Terms of Service. This Data Protection Policy regulates the collection and handling of Users’ personal data by Next Chance, resulting from accessing and using TheRanking.com.

USERS SHOULD READ THE DATA PROTECTION POLICY CAREFULLY, AS PART OF THE TERMS OF SERVICE EVERY TIME THAT THEY PROPOSE USING THERANKING.COM AND ANY OF ITS CONTENT OR SERVICES.

In any event, Next Chance reserves the right to change the Data Protection Policy at any time and without giving prior notice.

2. PERSONAL DATA

The personal data that the User provides to TheRanking.com, or those that are generated later as a result of the relationship between Next Chance and the User, will be handled and, where appropriate, incorporated into files, which are the responsibility of Next Chance. These personal data can be of various kinds, including images and audio.

Unless otherwise indicated in the forms on TheRanking.com where User data are requested, the collection and handling of personal data is for the purposes of:

(i) the management, development and compliance with the Contractual Relationship resulting from acceptance of the Terms of Service and any other general or additional terms by the User in order to use TheRanking.com (for example, competition rules or offers that the User decides to take part in).

(ii) making TheRanking.com technical media available for the use of Users in accordance with the Terms of Service.

(i) responding to requests, queries, or suggestions which, where appropriate, are sent by the User to Next Chance Stocks via TheRanking.com; and (iii) compliance of the applicable legislation by Next Chance.

The data that the User is asked for in the collection forms are obligatory unless otherwise stated on the form. In the case of a User not providing the obligatory data, Next Chance will not be able to process the form in question. On entering personal data, the User guarantees Next Chance that these data are correct, complete and true and that they refer only to the User and not to other people.

THE USER ACKNOWLEDGES THAT THERANKING.COM IS A WEBSITE THAT IS ACCESSIBLE ON THE INTERNET -THAT IT IS A MEDIUM THAT CAN BE ACCESSED BY THIRD PARTIES UNIVERSALLY AND FROM ANYWHERE IN THE WORLD- AND THAT THE USE OF CERTAIN CONTENT OR SERVICES CAN RESULT IN CERTAIN PERSONAL DATA PROVIDED BY THE USER (E.G., USER NAME, PICTURES OR AUDIO, COMMENTS OR INTERACTION WITH OTHER USERS) BEING ACCESSED BY OTHER USERS OF THERANKING.COM OR BY THIRD PARTIES. IN ADDITION, THE USER ACKNOWLEDGES THAT, IN INFRINGEMENTS OF THE APPLICABLE REGULATIONS.

3. REGISTRATION PROCEDURE

For the purposes of this document, “Content” is understood to mean any material which is written, visual, or sound or any other kind of material featured in TheRanking.com, including User Content, Third Party Content or Official Content and “Features” are understood to mean any feature or application that exists in TheRanking.com, such as registering in TheRanking.com as a User, the creation and publication of rankings by the User, voting on a ranking, the inclusion of comments or taking part in competitions, etc.

Part of TheRanking.com, its Contents and Features can be accessed by any third party without needing to register. However, certain Contents and Features will be reserved for the Users.

A User who wishes to access and enjoy all the Contents and Features in TheRanking.com should register as a User of TheRanking.com beforehand, providing all the personal data that are requested in the registration form. Once registration is complete, the User will be able to access the sections in TheRanking.com that are reserved for registered users by using the user name and password, without needing to register again. The registration form can be accessed by clicking here.

For registration, in particular, the User shall have to provide Next Chance with at least the data referring to their identity (first name and last name), e-mail address, date of birth, user name and registration password. The registered User is responsible for keeping their user name and password safe, which are for personal use, non-transferable and Next Chance should be contacted immediately in the event of suspecting that your user name and password have been used by third parties. You can manage and modify the data in your profile at any time in the section “My account” in TheRanking.com. Next Chance reserves the right to cancel the registration of a User at any time and for whatever reason without any obligation to compensate the User, e.g., if it is suspected that any details given by the User at the time of registering are not truthful (e.g., age).

4. MINORS

TheRanking.com is not directed at minors under the age of 14 years. IF YOU ARE UNDER THE AGE OF 14 YEARS, DO NOT USE THIS WEB PAGE., DO NOT REGISTER OR GIVE US ANY INFORMATION AT ALL ABOUT YOURSELF OR ANY OTHER PERSON (NEITHER FRIENDS, NOR FAMILY, ETC.).

5. THIRD PARTY DATA

In general, it is prohibited that Users provide any personal information about third parties to Next Chance or via TheRanking.com (e.g., name, address, e-mail address, telephone numbers, age, postal address, photographs, etc.). To use TheRanking.com, it is not necessary to provide data about third parties. A user may, in exceptional cases, provide data about third parties if prior consent has been obtained and notice given to the third party in question.

Specifically, in order that it is understood that consent has been obtained, the third parties should have been informed by the User and have accepted the Terms of Service and the Data Protection Policy. The User is solely responsible for gaining prior consent from the third parties.

6. USE OF COOKIES

Next Chance uses cookies when the User navigates around the web pages on TheRanking.com.

Cookies are a mechanism for collecting information which the TheRanking.com web pages transfer automatically to the hard disk of the User’s computer in order to copy data about the User’s visit and navigation in TheRanking.com. The information collected by these mechanisms is for the purposes of [improving the utilities and functionalities of TheRanking.com and analysing the uses that the User makes of the website and its different sections]. The cookies used by Next Chance in TheRanking.com are session cookies, meaning that they are only installed in the hard disk while the User is connected to TheRanking.com, and are uninstalled once the User closes the session.

The cookies are only associated with an anonymous User and computer, and they do not provide either the first or last names or any identifying data about the User of TheRanking.com. The User can configure their browser so that it notifies them about the reception of cookies and block them from being installed on the hard disk. To use TheRanking.com, it is not necessary to permit the installation of cookies sent by Next Chance; however, as a result, navigating around certain sites and web pages in TheRanking.com will not be optimal or may be considerably slower than usual.

7. USE OF IP ADDRESSES

An IP address is a number which is automatically assigned to the User’s personal computer or computer equipment by the User’s Internet provider. When the User visits web pages on TheRanking.com, Next Chance receives and finds out the IP address of the User.

Next Chance collects IP address numbers for various reasons, mainly for system administration, obtaining statistical information for the advertisers, and in general, to control and monitor the use and number of visits to TheRanking.com. Next Chance makes no relation between the IP address numbers and any data that allows the identification of any person in particular, which means that the User’s visit is registered, but the User remains anonymous. Next Chance reserves the right to use the IP address numbers for the purpose of, in collaboration with the User’s Internet provider, protecting the services and/or content of TheRanking.com or the interests of our clients or of third parties when faced with non-compliance of applicable regulations.

8. EXERCISE OF RIGHTS BY THE USER

To exercise the rights of access, rectification and cancellation of your data and to oppose the treatment received in accordance with the applicable regulations, the User should send an e-mail to the following address: info@theranking.com, accrediting the identity of the petitioner.
